Welcome to Bakery Brera! The terms “we”, “us” and “our” refer to Bakery Brera. Bakery Brera operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Bakery Brera is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.
Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, please discontinue use of the Services.

SECTION 1 - ACCESS AND ACCOUNT 
By agreeing to these Terms, you represent that you are at least the age of majority in your place of residence, and you consent to allow any minor dependents to use the Services on devices you own or manage.
To use the Services (including browsing, creating an account or making a purchase) you may be required to provide personal information including your email address, billing details and shipping information. You represent that all information you submit is accurate and complete.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer, sell or assign your account to any other person.

SECTION 2 - OUR PRODUCTS 
We aim to represent our products as accurately as possible; however:

  • Colours, appearance, decoration, texture and size may vary slightly due to the handcrafted nature of our baked goods and differences in screen displays.
  • Fresh products such as bread, pastries and cakes may have natural variation in shape, colour or size.
  • All product descriptions, prices and availability are subject to change without notice.

  • We may discontinue or limit the quantity of any product at our discretion. Due to daily freshness, items may sell out quickly and availability can vary day to day.

Our products are prepared in a bakery that handles common allergens including wheat (gluten), dairy, eggs, soy, tree nuts, peanuts and sesame. While we take reasonable care in preparation, we cannot guarantee that any product is free from traces of allergens. Customers with food allergies should review the product information carefully and contact us before ordering if they require further information.

SECTION 3 - ORDERS 
Placing an order constitutes an offer to purchase. Bakery Brera may accept or decline your order at its discretion. An order is considered accepted only after payment is processed and you receive an order confirmation email.
Please check your order carefully before submitting. Due to the perishable nature of our bakes, we are unable to cancel and may not be able to modify an order once it has been accepted.
If an order cannot be fulfilled, or if changes are required, we will attempt to contact you using the email or phone number you provided.
All purchases are final and are not returnable or refundable (refer to Return & Refund Policy), which forms part of these Terms of Service.

SECTION 4 - PRICES AND BILLING 
Prices, discounts and promotions may change without notice.
The price charged will be the price in effect at the time of purchase and reflected in your confirmation email. All prices include taxes. Delivery fees or additional charges are separate and will be calculated at checkout.
Online prices may differ from in-store prices or prices offered by third-party partner stores or marketplaces.
You agree to provide accurate and up-to-date billing and payment information. You represent and warrant that you are authorised to use the payment method provided.

SECTION 5 - DELIVERY 
Delivery is available within Singapore only. Delivery windows are estimates only and not guaranteed. Once products leave our bakery and are handed to the carrier:

  • Title and risk of loss pass to you.
  • We are not liable for courier delays, failed delivery attempts or items left at the delivery location.

  • Delivery fees are non-refundable once a delivery attempt has been made.

For failed delivery attempts, if the courier is unable to deliver your order (for example, if no one is available to receive it, the delivery location is inaccessible, or delivery instructions are incomplete or inaccurate), a second delivery attempt will not be made. The order will be returned to our bakery, and you will be responsible for self-collection during our operating hours. Because our products are freshly made and perishable, returned orders are not eligible for refund, replacement or re-delivery, and must be collected on the same day.
For self-collection orders, please arrive during your selected time slot. Due to freshness, uncollected items cannot be refunded, replaced or held overnight. Customers are responsible for inspecting their order upon collection. Once an order has been collected, responsibility for the products passes to the customer.

SECTION 6 - INTELLECTUAL PROPERTY
Your use of the Services grants you a personal, non-exclusive licence to browse and purchase from the site. All trademarks, text, images, graphics, layout and code belong to Bakery Brera, Shopify or associated licensors. No reproduction or redistribution is permitted without written consent. 

SECTION 7 - OPTIONAL TOOLS
You may be provided access to tools or features operated by third parties. These are provided “as is” and “as available” without warranties. Your use of such tools is at your own risk.

SECTION 8 - THIRD-PARTY LINKS
Links provided through the Services may direct you to third-party websites. We are not responsible for their content, accuracy or policies. Your interactions with third-party websites are solely at your own risk.

SECTION 9 - PRIVACY POLICY
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use and protect your personal data. By using the Services, you consent to the collection and processing of your data as outlined therein.

SECTION 10 - FEEDBACK
You grant Bakery Brera a perpetual, worldwide licence to use, publish or modify any feedback you submit, including reviews, suggestions or ideas.

SECTION 11 - ERRORS, INACCURACIES AND OMISSIONS
We reserve the right to correct typographical errors, inaccuracies or omissions in product listings, pricing or availability, and to cancel affected orders as necessary.

SECTION 12 - PROHIBITED USES 
You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services: (1) for any illegal, fraudulent or harmful purpose; (2) to violate any applicable laws or regulations in Singapore or elsewhere; (3) to infringe upon the intellectual property or privacy rights of Bakery Brera or any third party; (4) to harass, abuse, defame, threaten or otherwise harm any person; (5) to submit false, misleading or deceptive information; (6) to upload or transmit viruses, malware or other harmful code; (7) to send unsolicited advertising, spam or similar communications; (8) to impersonate any person or misrepresent your identity; (9) to scrape, crawl or collect data from the Services without permission; or (10) to interfere with the security, integrity or proper functioning of the Services.
We may suspend or terminate your access to the Services without notice if we believe you have violated these prohibitions.

SECTION 13 - TERMINATION
We may suspend or terminate access to our Services without notice for violations of these Terms or other misuse.

SECTION 14 - DISCLAIMER OF WARRANTIES
Bakery Brera provides the Services and products “as is” and “as available,” without warranties of any kind.

SECTION 15 - LIMITATION OF LIABILITY
To the maximum extent permitted by law, Bakery Brera is not liable for indirect, incidental, special, punitive or consequential damages arising from use of the Services or products.

SECTION 16 - INDEMNIFICATION 
You agree to indemnify and hold harmless Bakery Brera, our officers, employees, agents, contractors, partners and service providers, as well as Shopify, from any losses, damages, liabilities, claims or expenses (including reasonable legal fees) arising out of: (1) your breach of these Terms or any other policies referenced herein; (2) your violation of any applicable law or the rights of a third party; or (3) your misuse of the Services.
We will notify you of any claim requiring indemnification, and we may assume the defence of such claim at our discretion. You agree to cooperate with us in the defence or settlement of any such matter. We will not settle any claim in a way that imposes non-financial obligations on you without your consent (which will not be unreasonably withheld).

SECTION 17 - FORCE MAJEURE
Bakery Brera shall not be liable for any delay or failure to perform its obligations due to events beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, strikes, transport disruptions, power failures, government actions, or other unforeseen circumstances.

SECTION 18 - SEVERABILITY
Invalid provisions will be modified or severed without affecting the remainder of these Terms.

SECTION 19 - WAIVER; ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Bakery Brera with respect to the Services.

SECTION 20 - ASSIGNMENT
You may not assign your rights under these Terms without written consent.

SECTION 21 - GOVERNING LAW
These Terms are governed by the laws of Singapore, where Bakery Brera is headquartered.

SECTION 22 - HEADINGS
Headings are for convenience and do not affect interpretation.

SECTION 23 - CHANGES TO TERMS OF SERVICE
We may update these Terms at any time. Your continued use of the Services after changes are posted constitutes acceptance.
